DRUG OFFENSES can include everything from simple possession for personal use, to under the influence, to possession for sale, to manufacturing. Many drug charges can be prosecuted as either misdemeanors or felonies. Clients facing some of the less serious offenses are eligible for a form of “diversion” – that means going through drug treatment and proving your ability and commitment to stay sober. Completion of a court-ordered diversion program typically makes it easier to clean up your record at a later time.
DUI (DRIVING UNDER THE INFLUENCE) can be charged when you are suspected of driving with an excessive amount of alcohol and/or drugs in your system. A charge for DUI most often means you will have hearings both in court and with the DMV (Department of Motor Vehicles). Appointed counsel, such as the Public Defender, does not represent you with the DMV. You must hire private counsel for that purpose, or represent yourself (not usually a good idea!).
CONVICTIONS for even minor drug and alcohol charges can have lasting negative effects on employment status, state and Federal licensing, immigration status, and/or student loans and scholarships. You need early and aggressive assistance from Rancho Cucamonga criminal attorney Donna L. Connally to address both the criminal charges and the consequences of a conviction.
